With Premium Processing, USCIS guarantees adjudicatory action within 45 business days — approximately nine calendar weeks. Adjudicatory action means USCIS will issue one of three responses within that window:

  • Approval notice (Form I-797)
  • Denial notice
  • Request for Evidence (RFE) — the clock pauses while you prepare a response

If USCIS fails to act within 45 business days, they are required to refund the premium processing fee. In practice, most premium NIW cases receive a response within the stated window, though complex cases or those requiring additional review sometimes push to the edge of the timeline.

When Premium Processing Is Worth the Cost

The decision to pay $2,965 for premium processing depends on several factors.

If you are approaching an H-1B renewal deadline, premium processing matters. An approved I-140 enables H-1B extensions beyond the six-year cap — but only once it is actually approved. If your cap-out date is within 12 to 18 months and you are filing standard, you risk a gap between when you need the extension and when you have the approved petition in hand.

If your priority date will affect your I-485 filing window, speed matters. For Rest of World applicants where EB-2 is currently current, a faster I-140 approval allows faster I-485 filing — and with it, faster access to the EAD and Advance Parole combo card.

If you are an Indian or Chinese national managing a long-term backlog, premium processing is primarily useful for the certainty it provides. Your green card is not imminent regardless, but receiving a definitive approval or RFE quickly allows you to plan your status maintenance strategy without uncertainty hanging over a year-plus period.

If your NIW petition is strong and well-documented, premium processing carries low risk. The most common outcome for a well-prepared petition is approval or a manageable RFE. For petitions with borderline evidence — particularly on Prong 1 (national importance) or Prong 2 (individual positioning) — rushing to a faster decision does not improve your odds.

For Rest of World applicants, the NIW is typically faster end-to-end than the PERM route, which involves:

  • DOL ETA-9089 adjudication: 16–17 months
  • I-140: 15 business days (premium)
  • I-485: 8–14 months

Total PERM route: approximately 2.5 to 3 years.

The NIW route, with premium processing:

  • I-140: 45 business days (~9 weeks)
  • I-485 (once priority date is current): 8–14 months

Total NIW route: 12 to 24 months for Rest of World applicants.
